Article 1: Scope and use of the website

These general conditions of sale (hereinafter the “CGV”) apply to the website of the Kamberg brand, belonging to the company Cash Impact SAS with capital of 200,000 euros, having its headquarters at 9, Rue du Pilier, 93 300 Aubervilliers, France registered with the Bobigny RCS under number 503 429 581, and Intracommunity VAT number: FR16503429581 accessible at the address www.kamberg.fr (hereinafter the “website”) and for orders placed on website.

References such as “we” or “us” in these General Terms and Conditions refer to Cash Impact SAS, and any reference to “you” or “your” refers to you as a user of the Website.

We thank you for reading these General Terms and Conditions carefully before using the website and placing an order on the Website.

The sales contract is subject to French legislation.

Article 2: The sales contract

You declare that you have the legal capacity to enter into this contract, that is to say, that you are of legal age and are not under guardianship.

All products offered for sale on the Website are valid while stocks last.

Your order constitutes acceptance of our offer, the price offered and the designated products. Once your order is confirmed, you agree to be bound by a sales contract, subject to product availability and validation of your payment.

The items sold on the Website are presented with the greatest possible accuracy. The photos are intended to best present the products offered for sale; they are only indicative and are non-contractual.

Purchases made on the Website are solely for your personal use, or intended as a gift, and may not be used for a resale business.

Article 3: The order

You can view and modify the items in your order at any time by clicking on “My basket”.

Validation of the order implies irrevocable acceptance of these General Terms and Conditions.

Once the order has been validated, you will automatically receive an email confirming your order, including a summary of the items ordered. This email confirms that we have received your order, but does not constitute confirmation of product availability.

You will receive a second email when your items are ready to ship, which will be a confirmation of the availability of the items ordered. If the products ordered are no longer available, the order will be canceled and payment will not be made. If only some of the products ordered are available, shipping and payment will only concern the items available.

Article 4: Delivery times

Products purchased by the customer are generally delivered between 1 and 3 working days in mainland France. In all cases, the products are delivered within a maximum period of 30 days from the date of receipt of the second delivery email (day after the initial order). If this deadline is exceeded, the customer may request immediate termination of the sale and obtain reimbursement of the sums paid related to this sale.

Transport risks are the responsibility of the customer from the moment they leave the warehouse. The customer will be invited to check the condition of the packaging and the conformity of the items delivered and immediately report any anomaly to us.

If you order several products, we may have to send them to you in several installments. The products ordered will be delivered to the delivery address you indicated at the time of your order. We cannot be held responsible in the event of an incorrect or incomplete address.

Article 5: Price and delivery costs

The prices on the website are indicated in Euro and are inclusive of VAT (all taxes included, including VAT at the legal rate in force).

Prices are guaranteed subject to typographical errors.

The prices indicated on the website exclude delivery costs.

Delivery costs are indicated on the delivery and returns page of the website. These delivery costs are in addition to the prices indicated for the products. Before final validation of the order, the customer is informed of the full price to pay.

Prices are subject to change. The products are invoiced on the basis of the prices in force indicated on the website at the time of validation of the order.

Products purchased are payable in full in cash on the day the order is placed. Delivery of the product will only take place after payment in full for the product. The transfer of ownership of the products occurs after payment in full.

Article 6: Payment, non-payment

Payment for the products must be made by credit card, following the instructions on the payment page.

The full price, including shipping costs, will be charged to your payment card when the ordered products are dispatched.

You certify to us that you are the holder of the bank card used when paying for your items.

If the card issuer refuses to authorize payment, the order will not be validated and the goods will not be sent. We will send you an email to inform you of the refusal.

Purchases are made securely. For payments by bank card (credit card, visa credit card and e-credit card), our partner Stripe takes care of payment security. All information that Customers communicate to Kamberg France is strictly protected and guarantees the compliance and security of each transaction.

Article 7: Product return

If you are not satisfied with the products ordered, you have 14 (fourteen) days from the delivery of your order to request a product return.

You have 14 days from receipt of your item to notify us of your intention to return the products and the reasons for this return. To do this, simply send an email to info@kamberg.fr.

Reimbursement of the full price of the products purchased will be accepted if the following conditions are met:

• The products are returned in their original condition and complete, have not been damaged or used with the packaging and any accessories (lids, sleeves, etc.) are also returned.
• The return form is attached to the package.
• The products are returned to the address indicated on the return slip.

The refund of your returned product(s) will be made in full by bank transfer to the bank account used for the order within a maximum period of 30 days following receipt of the returned goods.

If we receive your returned items more than 14 working days from receipt of the ordered products, we reserve the right not to refund the products. The items will be returned to you.

We are not obliged to accept returns in conditions which do not comply with paragraph 3.

Article 8: Personal data

The information collected on the website is strictly confidential and is only intended for us, for the purpose of processing your order. You are informed that this information is subject to automated data processing.

You guarantee to us that the information entered on the website relates to your true identity and is true.

It is your responsibility to modify any information transmitted that is incorrect or no longer valid in the “my account” section. We cannot be held responsible for the consequences of this failure to update your personal data.

In accordance with the law, you have the right to access and modify your personal information in the “my account” area, and the right to oppose this data.

Article 9: Liability

For any order placed on the website, our liability to you regarding loss or damage that may be subject to these General Terms and Conditions is limited to the purchase price of your order.

We cannot be held responsible for delays or failures to comply with the obligations provided for in these General Terms and Conditions in the event of events occurring beyond our control (strike, accidents, serious incidents, etc.).

We are not responsible for any inconveniences or damages relating to the use of the internet network and the website (service interruption, computer viruses, external intrusions, etc.).

Article 10: Guarantees

You benefit from the legal guarantee of conformity and the guarantee against hidden defects. If the products sent are not compliant, you are invited to contact us immediately after receipt.

In the event of non-compliance, the costs of returning the products will be our responsibility.

The website which is made available to you is intended solely for your personal and private and non-commercial use. The content of the website may not be used for any other purposes whatsoever without our express written consent.

Article 12: Applicable law / disputes

All elements of the website are the exclusive intellectual property of Kamberg France.

These conditions of sale are subject to French law. In the event of a dispute, an amicable solution will be sought and favored before any legal action. Failing this, disputes will be submitted to the competent courts of common law.

Article 13: Modification of the general conditions of sale

The General Conditions of Sale may be subject to change or modification; the General Terms and Conditions applicable to the customer's order are those available on the website on the date of validation of the order.
